A new Construction Code has entered into force in Kazakhstan.
The new Construction Code of the Republic of Kazakhstan, developed on the instructions of the Head of State, Kassym-Jomart Tokayev, is aimed at comprehensive modernization of the industry, taking into account the current market requirements and large-scale digitization processes of the economy. The document provides for the control of urban development projects through the cadastral system, as well as the restriction of the issuance of permit documentation that contradicts the master plans. In order to ensure the transparency of the decisions made, urban development projects are brought out for public discussion, and their results are published on the Internet resources of local executive bodies. Frequent correction of detailed planning projects is prohibited (no more than 1 time in 2 years). In order to ensure the safety of citizens, the requirements for conducting construction through seismic risk assessment, mandatory consideration of microseismic zoning maps and other safety mechanisms have been strengthened. The creation of the national institute of technical regulation allows to form a modern and flexible system of technical regulation. In order to increase the qualification and professional status of engineers, a certification system of specialists will be introduced instead of the attestation system based on the experience of the European Union countries. This norm will come into force after 2 years. The introduction of an electronic register of license holders allows for a complete check of previously issued permits. It is also planned to strengthen state control over construction by introducing a planned inspection mechanism. State architectural and construction control bodies (SCB) have the right to take immediate measures of influence against persons who have violated the requirements in the field of architecture and urban planning, including suspending construction works and the use of permit documents. In addition, the state architectural and construction control and fire safety authorities participate in the procedure of acceptance of construction objects. At the same time, the main warranty period for building objects has been increased from 2 to 5 years, and the warranty period for lifting structures, roofs and facades has been increased to at least 10 years. Integrating existing information systems and monitoring the planning, design, expertise and construction process, i.e., all stages of work on a “one-stop” basis Qportal.kz a single construction portal was created. For the purpose of uniform identification of construction objects, each object is given a unique object number (BNN). The provisions of the construction code were extensively discussed in various forums with the participation of business representatives, industry associations and the expert community.
